Prenuptial agreements, called premarital agreements in California and pre-nups by most everyone, are agreements made before marriage that deal with property, both money and real property, and with the question of spousal support after the marriage. Some pre-nups also try to deal with custody of children, which isn't actually allowed in most states. Getting an experienced and knowledgeable lawyer for a pre-nup is very important, because a poorly drafted pre-nup may be thrown out in its entirety if it's challenged in court.
A good pre-nup should reflect your specific relationship, and for this reason we discourage people from using form pre-nups.
