Estate Problems

Many problems can come up from an estate, including the obvious like a contested will, or a lawsuit between inheritors over the inheritance. There are also more serious cases, for example criminal charges alleging fraud or ID theft. Unfortunately it’s not uncommon for family members to feel a lot of grief during the estate process, and sometimes this grief turns into anger, often against the person who administered the estate or who decided how exactly payments would be made. Similarly, there can be serious questions about care-takers, or wills that were drafted after a person started showing signs of dementia.

For any of these problems, you need a firm that works in more than one field. A firm that’s only active in probate can’t give you good advice about the consequences of calling the police about a relative you feel mishandled funds, because they don’t know how the local DA approaches mandatory minimum sentencing, and they’re probably not competent to offer you advice on what if any criminal exposure you might have. In the same vein, if there’s a civil lawsuit planning or proceeding between family members, it’s crucial that your attorney know how the local civil court system interacts with the local probate system, and ideally, you want someone that can draft a civil settlement in conformance with the probate rules in your area.
